Terms of Service

These Terms of Service ("Terms") govern your use of AeroSpottle ("we", "us", "our"), the aviation guessing game available at aerospottle.xyz. By accessing or using AeroSpottle you agree to these Terms. If you do not agree, do not use the site.

1. Eligibility

You must be at least 13 years old to use AeroSpottle. If you are under 18, you confirm that you have your parent or guardian's permission to use the site and agree to these Terms on your behalf.

By creating an account you confirm that the information you provide is accurate and that you are not previously banned from AeroSpottle.

2. Accounts

You are responsible for maintaining the confidentiality of your account and password. You are responsible for all activity that occurs under your account.

You may only create one account per person. Creating duplicate accounts to evade a ban or gain an unfair leaderboard advantage is prohibited and may result in all accounts being permanently banned.

You must not share your account with others or allow others to access it.

3. Usernames and Content

Your username must not:

• Impersonate another person or organisation
• Contain offensive, hateful, or obscene language
• Include personal information such as a real name, phone number, or address

We reserve the right to reset your username at any time if it violates these rules, without notice.

Any content you submit (such as a profile bio) must not be offensive, illegal, or harassing. We may remove content that violates these Terms.

4. Acceptable Use

You agree not to:

• Cheat, use automation, scripts, or exploits to manipulate game results or leaderboard standings
• Attempt to access, modify, or disrupt the accounts of other users
• Attempt to access the admin panel or any restricted area of the site
• Use the site in any way that could damage, disable, or impair it
• Harass, threaten, or abuse other players
• Use the site for any illegal purpose

5. Moderation and Account Actions

We reserve the right, at our sole discretion, to take any of the following actions on any account at any time:

• Issue a warning visible on next login
• Reset a username
• Remove leaderboard entries
• Temporarily or permanently ban an account
• Permanently delete an account and all associated data
• Grant or revoke Pro status

These actions may be taken with or without prior notice, for violations of these Terms or for any behaviour we determine is harmful to the community or site.

Bans are tied to your account. Attempting to evade a ban by creating a new account may result in the new account also being banned.

6. AeroSpottle Pro — Subscription

AeroSpottle Pro is a paid subscription that unlocks additional features. The current pricing is:

• Monthly — $5.00 USD per month
• Yearly — $45.00 USD per year

Auto-renewal. Subscriptions renew automatically at the end of each billing period. You authorise us to charge your payment method on file through Stripe for the applicable amount at the start of each new billing period.

Cancellation. You may cancel your subscription at any time through the Manage Subscription link on the membership page. Cancellation takes effect at the end of the current billing period — you retain Pro access until then. Cancelling mid-period does not entitle you to a partial refund.

Failed payments. If a payment fails, your Pro access will be suspended until the payment issue is resolved. Stripe may retry failed payments according to its own retry schedule.

Price changes. We may change subscription pricing with at least 14 days' notice. Continued use of your subscription after a price change takes effect constitutes acceptance of the new price.

Pro features. The features included in Pro may change over time. We do not guarantee that any specific feature will remain part of the Pro tier indefinitely.

7. Intellectual Property

All content on AeroSpottle — including game mechanics, design, code, and photography — is owned by or licensed to AeroSpottle. You may not copy, reproduce, distribute, or create derivative works from any part of the site without our written permission.

Using AeroSpottle does not grant you any ownership or intellectual property rights in the site or its content.

8. Disclaimers

AeroSpottle is provided "as is" without warranties of any kind, express or implied. We do not guarantee that:

• The site will be available at all times or free from errors
• Leaderboard data or streaks will be preserved indefinitely
• Any particular game mode or feature will remain available

We reserve the right to modify, suspend, or shut down any part of AeroSpottle at any time without notice.

9. Limitation of Liability

To the maximum extent permitted by law, AeroSpottle and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site, including but not limited to loss of data, loss of streaks, or loss of account access.

Our total liability to you for any claim arising out of these Terms or your use of AeroSpottle shall not exceed the amount you paid us in the 12 months prior to the claim, or $10 USD, whichever is greater.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which AeroSpottle operates. Any disputes shall be resolved in the courts of that jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

11. Changes to These Terms

We may update these Terms at any time. When we do, we will update the effective date at the top of this page. Continued use of AeroSpottle after updated Terms are posted constitutes your acceptance of the changes. If the changes are material, we will make reasonable efforts to notify you.
